This U.S. Privacy Policy describes our practices regarding the collection, use and +disclosure of personal information collected by ALDI Inc. (“ALDI” or “we,” “us,” or “our”) through our websites, web pages and mobile applications that post or include a link to this U.S. Privacy Policy (including those listed here(https://www.aldi.us/terms-of-use/scope-of-us-online-privacy-notice/), and by Aldi offline (collectively, the “Services”).  This U.S.  Privacy Policy describes the types of personal information we collect on the Services, how we may use the information, with whom we may share it and the choices available to you regarding our use of the information.  We also describe the measures we take to safeguard the information and tell you how to contact us about our privacy practices.

We collect information from you directly, automatically when you visit the Services and sometimes from third parties. Some of this information may be considered “personal information” or “personal data”, and some of which may be considered “sensitive”, under various applicable laws. We consider information that identifies you as a specific, identified individual to be personal information (such as your name, phone number, e-mail address, etc.), and we treat additional information, including IP addresses and cookie identifiers, as “personal information” where required by applicable law. And, if we combine information we consider to be non-personal with personal information, we will treat that combined information as personal information under this U.S. Privacy Policy. Note that we may de-identify or pseudonymize personal information so that it is non-personal, either by combining it with information about other individuals and/or by hashing the information or otherwise removing characteristics that make the information personally identifiable to you. We will treat de-identified or pseudonymized information as non-personal to the fullest extent allowed by applicable law. We maintain and use de-identified data without attempting to re-identify it, except where permitted by applicable law, such as to determine whether our de-identification processes satisfy legal requirements.

Information You Provide Us Directly

We may ask you to provide information when you interact with us, including contact information and other personal information, payment information (for example, credit card or gift card information), demographic information (for example, your gender, age or similar information), and other information as set forth below. Certain features on our Services may also collect information about your preferences and interests. We may also collect information from you when you interact with our customer service team, whether by phone, email, webform submission or physical mail, or if you respond to our text messages. We may also collect information from you when you interact in-store with our associates. 

The types of personal information we may collect may include: 

  • Identifiers, such as name, nickname, postal address, email address and telephone number;
  • Purchaser’s date of birth (in connection with our legal obligations in the context of alcohol sales);
  • login credentials for our Services (such as a username or email address and password);
  • payment information (such as credit or debit card or EBT number, security code, expiration date and billing address);
  • shopping list and purchase history information;
  • in connection with our careers pages, personal information contained in your resume, cover letter or other documents submitted online, including your name and education history; and
  • content and other data posted to our Services and social media pages, and information we obtain through ALDI-related social media apps, tools, widgets and plug-in

Information We Collect By Automated Means

When you visit or otherwise interact with our Services, we and our third party business partners (including any third party service providers or third party analytics or content or advertising providers) may collect certain “Usage Information” by automated means, using technologies such as cookies, web server logs, image pixels, web beacons and JavaScript (collectively referred to as “Tracking Technologies”). Usage Information may include your device IP address or other unique device identifier (“Device Identifier”), web browser characteristics, device characteristics, operating system, language preferences, referring URLs, clickstream data, and dates and times of website visits. In some cases, we may directly collect location information through your device. You may be able to turn off the collection of location information through the settings on your device.

We use the following types of Tracking Technologies to automatically collect information when you interact with us online:  

Cookies and Local Storage. A “cookie” is a text file that websites send to a visitor’s computer or other internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. These technologies may be used for many purposes by us, our service providers, and our third-party business partners, such as automatically collecting Usage Information, enabling features, serving advertisements to you online, and remembering your preferences. We may use cookies and other technologies to help keep your use of the Services more secure, to study traffic patterns on the Services, to study the effectiveness of our customer communications, to maintain the integrity of the Services, to measure crash analytics and other maintenance related information, to manage and measure the performance of advertisements displayed on or delivered by or through the Services, and to personalize your experience through the Services, such as to recognize you when you return to the Services. The information we store includes internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. If you do not want to accept cookies, you can block them by adjusting the settings on your Internet browser, or depending on your location, via settings we make available on our Services. Web Beacons. Web Beacons (also known as clear GIFs and pixel tags) are small pieces of code used to collect usage analytics.  They help us to determine, for instance, whether a page has been viewed or not and, if so, how many times. When you ask us to send you information on a promotion or a newsletter, we may use web beacons to establish when an email is opened.

Embedded Scripts. An embedded script is programming code designed to collect information about your interactions with our Services, such as the links you click on. The code is temporarily used by our server or a third-party service provider or business partner while you browse or interact with our Services and is deactivated or deleted when you disconnect from our Services.

Software Development Kits (SDKs). An SDK is a software package that contains a set of tools that can be used to help build applications and implement new features in existing apps. These tools can be used to create and operate features that collect information from your device. 

Mobile Applications. When you use our mobile applications (“Apps”), we also may collect certain information by automated means, such as through device logs, server logs and other technologies. The information we collect in this manner may include the device type used, the mobile operating system and version, device identifiers and similar unique identifiers such as the ID for Advertising (IDFA) on Apple devices, and the Advertising ID on Android devices, device settings and configurations, IP addresses, battery and signal strength, mobile network information, usage statistics, referring emails and web addresses, dates and times of usage, actions taken on the Apps and other information regarding use of the Apps. In addition, we may use a variety of other technologies that collect similar information for security, fraud detection, and maintenance purposes. We may also collect your mobile device’s geolocation information. With your permission, we may receive the precise geolocation and other location information of your mobile device through GPS, Bluetooth and WiFi signals, and other technologies to provide you with the Apps, facilitate online orders and offer you personalized coupons and other offers. Your device’s operating platform may provide you with a notification when the App attempts to collect your precise geolocation. Please note that if you do not allow the App to collect your precise geolocation, you may not be able to use all the Apps’ features or the offers available through the Apps. However, also note that we may still be able to collect or infer your approximate location through other information we collect, such as IP address. In addition, some mobile service providers may also provide us or our third-party service providers with information regarding the physical location of the device used to access the Services.

ALDI may record session interactions with Service user interfaces, including what pages you visit on the Services, how long you visit those pages, the links you click, and your path through the Services, for website analytics purposes, solely for our internal business purposes, to improve the Services and our products and services.

Information We Collect From Third Parties About You

We may receive information about you from third parties, such as business partners (including companies that assist us with online advertising and analytics), data providers who enhance the information we have about you, sources of publicly available information, and other users of the Services (such as when they provide your information to send you one of our products or participate in a “refer a friend” or similar programs that we may offer). And we may supplement the information we collect with outside records from third parties, such as public databases, publicly available Social Media pages, and third parties who enhance the information we have about you.

We use this information to better provide you with information and products, to tailor our content and the offers we show you, and for other business purposes.  

Social Media Interactions: We may facilitate interactions with social media platforms, like Facebook, YouTube, Pinterest, and Instagram. You may also have the opportunity to log in through or otherwise connect your social media account. When you interact with social media through the Services, we will receive information about you from the social media service and you will be choosing to share information about your interactions with ALDI with that social media service.

In addition, the social media service may set their own cookies and collect information about your use of the Services, including your IP address or other device identifiers, and which pages you visit on the Services. These social media platforms may be able to collect certain information on your visits to the Services regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the social media platform. If you are logged out or do not have an account and visit a page with a social plug-in, your browser sends a more limited set of information. Like other sites, the social media platform will receive information about the webpage you are visiting, the date and time of your visit, and other browser-related information. They may use that information to help them improve their products or for other purposes set forth in their privacy policy. We may also receive information about you if other users of social media give us access to their profiles and you are one of their connections or "friends."

The information we collect is subject to this U.S. Privacy Policy. The information collected and stored by the third party remains subject to the third party’s privacy practices, including, without limitation, whether the third party continues to share information with us, the types of information shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect information about you through the application or feature but may retain the information previously collected.

If you choose to post information to a third-party platform, that information may be public.

How We Use The Information We Obtain

We may use non-personal information for any purpose allowable by law, including for advertising, research, and marketing purposes. We use information collected from or about you, including personal information and Usage Information, as disclosed in this U.S. Privacy Policy, including to:

  • Offer and provide products, services and information to you;
  • communicate with you about your requests, questions and comments, and administer your participation in special events, programs, surveys, contests, sweepstakes, and other offers or promotions from us and third party marketing offers from our trusted partners, as well as from other companies;

  • contact you about your use of the Services or similar administrative communications, or to provide you with Service updates, newsletters and other informational materials;
  • recognize you across the Services and across devices;

  • process orders and payment transactions;
  • process your registration when you sign up for an account

  • manage and execute delivery and grocery pick-up services;
  • provide interest-based content and advertising to you based on the way you browse or shop on the Services and other platforms;

  • enable you to interact with ALDI through social media;
  • operate, evaluate and improve our Services and business (including developing new products and services; determining the effectiveness of our sales, marketing and advertising; and analyzing and enhancing our products, services and Services, including our mobile applications);

  • perform data analyses and other processing (including market and consumer research, trend analysis, financial analysis, anonymization, encryption and tokenization of personal information);
  • process employment applications, including by assessing qualifications, verifying information, conducting reference or other employment-related checks (if you submit an application for employment);

  • ​​​​​​​protect against, identify and prevent fraud or other criminal activity, claims and other liabilities;

How We Share Your Information

 ALDI may share non-personal information, which may include Usage Information and information that has been hashed or otherwise de-identified or pseudonymized, with third parties in our discretion and as allowed by law, including for targeted advertising purposes. We do not share your personal information with third parties for those third parties’ own direct marketing purposes unless you consent (opt-in or opt-out) to such sharing.

We may share the information we have collected about you as allowed by law and as disclosed at the time you provide your information, as described in this U.S. Privacy Policy, with your consent, and in the following circumstances:

Third Party Service Providers. We may share information with third party service providers or allow those third parties to collect information about you, to enable them to perform services on our behalf, such as website hosting, conducting website usage analytics, sending email, text, or other communications, fulfilling orders, providing marketing assistance and data analysis, processing payments, and other services. Additionally, we may share various information relating to our users and fraudulent or potentially fraudulent activities with our fraud prevention and similar service providers, and they will use this information to help us and their other clients prevent fraudulent and illegal transactions.

Our Business Partnerships.  When you use the Services to interact with third parties who operate certain portions of the Services, those third parties may share certain information about you with us (as described above) and we may also share certain information with that third party.  The information may include your personal information, which the third party may use for the purpose of directly sending you communications and promotional materials regarding their goods and/or services, directly or through the Services.  It also includes information regarding your use of the Services and the products you purchase.

At Your Request and When You Post Content Publicly. We may share information when you direct us to do so. For example, you may be presented with an opportunity to receive marketing offers from a third party, or you may choose to write a product review, share a wish list, send a message, or engage with a social media service or third party application or feature, through which information about you is shared. Please note that we are not responsible for the privacy practices of third parties.

In addition, we or a third-party social networking or review platform may offer features, such as message boards and other public areas, where you can choose to interact with others and/or submit content or post publicly. Content that you post publicly may be viewed, collected, and used by others, and the protections of this U.S. Privacy Policy will not apply.

Fusion92: Our Weekly Ads pages are operated by Fusion92 (“Fusion92”), whose own privacy policies apply to the collection, use and disclosure of information obtained through the Weekly Ads pages by Fusion92 and its partners (such as Fusion92 ad networks). Fusion 92’s privacy policy can be found here: https://www.aldi.us/weekly-specials/our-weekly-ads/?path=privacypolicy. Fusion92 may set and access its own tracking technologies on your device (including cookies and web beacons), and it may otherwise collect or have access to Usage Information and other information about you, some of which may be personal information under various state laws..  

Google reCAPTCHA: We use Google’s reCAPTCHA service to protect our Services from spam and abuse. Your use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Use.

Parent and Affiliated Entities: We may share information with our affiliates and subsidiaries for internal business, analytical, and operational purposes.

Sweepstakes, Contests and Promotions: We may offer sweepstakes, contests, and other promotions (any, a “Promotion”) that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may contain specific requirements of you (including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, as required by law, or as permitted by the Promotion’s terms or official rules (such as on a winners list).

Employment Applications: If you apply for a job through the Services, we or our service provider(s) may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission and other federal, state and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, we and/or our service provider may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment-related complaints. Please note that we may utilize a careers portal that is operated by a third party, in which case your use of the careers portal will be subject to the third party’s privacy practices as disclosed on the portal, and not to this policy.

Administrative/Legal Reasons. We also may disclose information about you (i) if we are required to do so by law, regulation or legal process (such as a court order or subpoena), (ii) in response to requests by government agencies, such as law enforcement authorities, (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity; (iv) to protect and/or defend the Terms of Use, or other policies applicable to a Service; or (v) to respond to an emergency. 

Business Transitions. We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution or liquidation); by providing your information, you understand and agree that we may transfer such information to the acquiring entity without your further consent.

Third Party Advertising & Analytics

ALDI works with third party business partners (such as network advertisers, ad agencies, analytics providers, and other advertising partners) to serve ALDI ads online, to serve third party ads on the Services, and to provide us with information regarding the use of the Services and the effectiveness of our advertisements. These third parties may set and access their own tracking technologies on your device (including cookies and web beacons), and they may otherwise collect or have access to Usage Information and other information about you, some of which may be personal information under various state laws. Some of these parties may collect personal information over time when you visit the Services or other online websites and services. We may share information, typically information that has been hashed or otherwise de-identified or pseudonymized (including hashed email addresses), Usage Information, and location information, with third party advertising companies, analytics providers and other third parties for the purpose of serving you more relevant ads on and off the Services.

We use Hotjar’s third-party web analytics services to better understand our users’ needs and to optimize our Services. To learn more about Hotjar and how to opt out, visit https://www.hotjar.com/policies/do-not-track/.

We use Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps, and online services. We may use a variety of companies to serve our advertisements. Some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising and you may want to visit the following webpages, which provide “opt-out” mechanisms for participating companies: https://optout.networkadvertising.org and https://optout.aboutads.info.

Mobile devices may contain settings that allow you to disable tracking advertising and/or analytics. In addition, the digital advertising industry has provided the ability for mobile users to register their intent not to receive targeted advertising at http://www.aboutads.info/appchoices.

Please note opting out through these mechanisms does not opt you out of being served advertising and you will continue to receive generic ads while online.

“Do Not Track” and Global Privacy Control Signals

Changing Your Information

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of registration. Certain Services allow you to correct or update certain personal information you have provided. Notice to Nevada Residents

Nevada S.B. 220 provides consumers with the ability to opt out of the sale of their personal information. We do not sell your personal information as defined in S.B. 220. However, if you are a Nevada resident, you may still submit an opt-out request, and if our practices were to change in the future, we would honor your request. Your request to opt out of the sale of your covered information must be submitted to data.privacy@aldi.us. Your request must include your full name, street address, city, state, zip code, and a valid email address so that we can contact you if needed regarding your request. If you previously provided a phone number, including it will assist us in making sure we identify you as someone who wants to opt out. You may be required to take reasonable steps as we determine from time to time to verify your identity and/or the authenticity of your request.

We may require documentation to authenticate the resident’s identity and that you are authorized to submit the request on the resident’s behalf in order to be able to fulfill your request. Notice To California Residents

This California Consumer Privacy Notice (“Notice”) supplements the U.S. Privacy Policy.  It applies solely to California residents (“California Consumers”) and addresses personal information we collect online and offline. This Notice sets forth the disclosures and rights for California Consumers regarding their personal information, as required by the California Consumer Privacy Act, the California Privacy Rights Act of 2020, and any implementing regulations adopted thereunder (collectively, the “CPRA”). 

This Notice does not apply to Aldi Inc. personnel, who should refer to the separate ALDI California Personnel Privacy Notice. 

This Notice uses certain terms that have the meaning given to them in the CPRA, unless otherwise defined.

EXERCISING YOUR CALIFORNIA RIGHTS

California Consumers have the right to request: (1) that we disclose to you what personal information we collect, use, disclose, share, and sell, including the right to request that we provide to you the categories and specific pieces of personal information we have collected about you ("Right to Know"); (2) that we delete the personal information we collect about you ("Right to Delete"); (3) that we correct inaccurate personal information we hold about you (“Right to Correct”); (4) to opt-out from the sharing of your personal information to a third party for cross-context behavioral advertising (i.e. targeted advertising) (“Right to Opt-Out of Sharing”); (5) to opt-out from the sale of their personal information and sensitive personal information (“Right to Opt-Out of Sales”); and (6) that we limit the use or disclosure of your sensitive personal information to purposes set forth in the statute, including that use which is necessary and anticipated to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services (“Right to Limit The Use and Disclosure of Sensitive Personal Information”), all subject to exceptions set forth in the CPRA. More information on each of these rights is below.

In your request, you must provide enough information to allow us to verify you are the person about whom we collected personal information, or their authorized representative. You must also describe your request with enough detail so that we can understand, evaluate and respond to it. We can’t respond to your request if we can’t verify your identity. Making such a request does not require you to create an account with us, and we will only use the information you provide in a request to verify your identity.

Verifying Your Requests
We will take reasonable steps to verify your identity based upon the information you provide and the type of request you are making.

When you exercise your Right to Know, Right to Delete, and/or Right to Correct, we may ask that you provide us with information, beyond your full name, in order to verify your identity and fulfill your request. If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request. Pursuant to the CPRA, we will not require you to verify your identity, beyond asking for the information necessary to complete your request, when you exercise your Right to Opt-Out of Sharing, Right to Opt-Out of Sale, or Right to Limit the Use and Disclosure of Sensitive Personal Information.

Agents
If you are an authorized representative submitting a request on a user’s behalf, please complete the applicable request per the instructions below. You may also make a request on behalf of your minor child. We will follow up to request a signed, written permission signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request and needs to be clear about the permission granted. Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465.  In either case, please also indicate in your email the nature of your request. The consumer’s identity, in addition to your own, will need to be independently verified in order for us to be able to fulfill your request.  We may also ask the consumer to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the consumer’s behalf, we may deny the request. Right to Know
California Consumers have the right to know what information we have collected about you, including both the categories of personal information and the specific pieces of information.

In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

Right to Delete
In accordance with the CPRA, California Consumers have the right to request that we delete the information we have collected from you.

Please note that as part of the verification process, once you submit a request to delete, we may follow up and require you to confirm that you want your information deleted.

Right to Correct Inaccurate Information
California Consumers have the right to request that we correct inaccurate information we hold about you. If you are a California Consumer and would like to exercise your Right to Correct, please submit your request by emailing data.privacy@aldi.us, or by calling us at 833-602-2534.

Right to Limit The Use and Disclosure of Sensitive Personal Information
Under the CPRA, a business must only provide the Right to Limit The Use and Disclosure of Sensitive Personal Information when sensitive personal information is collected or processed for the purpose of inferring characteristics about a consumer, or does not fall under certain statutory exceptions, pursuant to CPRA § 1798.121. ALDI’s use and disclosure of sensitive personal information is not used for such purposes and/or falls within the statutory exceptions and we therefore do not offer such opt-out right at this time.

Do Not Sell or Share
California Consumers have the right to opt-out of the sale or sharing for cross-context behavioral advertising (i.e., targeted advertising) of your personal information or sensitive personal information to a third party. If you are a California Consumer and would like exercise your Right to Opt-Out of Sale or Sharing, please submit your request at data.privacy@aldi.us or by calling us at 833-602-2534.  

Other Important Information for Do Not Sell or Share
ALDI engages in online advertising practices (and certain analytics or similar activities), which may be considered a “sale” or “share” for cross-context behavioral advertising as defined in the CCPA and CPRA. To disable sharing through cookies set by 3rd parties that may be considered "sales" or “sharing” under the CCPA and CPRA, click on the Cookie Preferences link in the Footer of the site.

In addition, the Digital Advertising Alliance also offers tools for California consumers to send requests under the CCPA and CPRA to opt out of the sale of personal information by some or all of the participating companies, which can be found here: https://www.privacyrights.info/.

Data Retention
We will retain all categories of personal information described in this Notice for as long as it is reasonably necessary for the purposes set out in this Notice, considering the time period reasonably necessary to: enable you to exercise the choices and rights you have requested; comply with our contractual obligations; enforce our terms for use of the ALDI Services; and comply with legal and regulatory requirements. Except as noted differently on specific pages or apps, we retain your personal information while you have an account with us, or while you are using our Services or continuing to visit us.   

Users Younger than 16
ALDI does not knowingly collect or sell Personal Information of users younger than 16 years of age.

The Personal Information we collect about you will depend upon how you use the ALDI Services or otherwise interact with us. Accordingly, we may not collect all of the below information about you.

Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section 1798.83, also known as S.B. 27) allows California residents to request from companies conducting business in California certain information relating to third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties’ direct marketing purposes.  Alternatively, the law provides that a company may comply, as ALDI does, by disclosing in its privacy policy that it provides consumers choice (opt in or opt out) regarding sharing personal information with third parties for those third parties’ direct marking purposes, and information on how to exercise that choice.  As stated in this U.S. Privacy Policy, ALDI provides you choice prior to sharing your personal information with third parties for their direct marketing purposes.  If you do not opt-in or if you opt-out at the time we offer that choice, we do not share your information with that identified third party for its direct marketing purposes.
