ALDI Grand Opening Golden Ticket Promotion

Official Rules ("Official Rules")

No purchase or payment of any kind necessary to enter or win a Prize (as defined below) in the Promotion (as defined below). A purchase will not increase your chances of winning.   Void where prohibited by law.

The Promotion is open to legal U.S. residents who reside within fifty (50) miles of the applicable ALDI store location (“Location”) having a “Grand Opening” and are at least 18 years old and the age of majority in their jurisdiction of residence.

By entering the Promotion, you agree to these Official Rules, which are a contract, so read them carefully. Without limitation, this contract includes indemnities to the Sponsor from you and a limitation of your rights and remedies.

Note that the “ARBITRATION AGREEMENT” section below contains provisions that require, where permitted by law, all disputes arising out of or relating to participation in the Promotion – with limited exceptions – to be resolved in binding arbitration, and not in court, and that you and ALDI INC. waive the right to bring or participate in a class action in connection with such disputes. Please read the ARBITRATION AGREEMENT carefully. By participating in the Promotion, you hereby agree to be bound by the ARBITRATION AGREEMENT.

1. Overview:

The ALDI Grand Opening Golden Ticket Promotion for the ALDI Location(s) having a Grand Opening (“Promotion”) is available on the applicable date(s) as communicated and advertised by Sponsor (as defined below) (the, “Event Date”) during the store hours or while supplies last, if earlier (the “Promotion Period”). During the Promotion Period, eligible participants (see ELIGIBILITY section) can visit the ALDI Location. The first one hundred (100) visitors will receive a Prize (see PRIZES & APPROXIMATE RETAIL VALUES (“ARV”) section) by following the instructions in the HOW TO ENTER section below. Entry into the Promotion does not result in entry into any other promotion offered by Sponsor.

2. Sponsor:

The Promotion is sponsored by ALDI INC., 1200 N. Kirk Rd., Batavia, IL 60510 (“Sponsor”).

3. Eligibility:

The Promotion is open to legal residents of the United States who reside within fifty (50) miles of the applicable ALDI Location having a “Grand Opening” (the “Territory”). Employees, officers, directors, members, managers, agents, and representatives of Sponsor, or its respective corporate parents, partners, divisions, subsidiaries, affiliates, assigns, and successors in interest, each of their respective advertising, promotion and public-relations agencies, and any other party participating in the development, design, administration, or fulfillment of the Promotion (collectively, the “Released Parties”), and the immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, of any such person are not eligible to participate or win.  

4. How To Enter:

To participate in the Promotion, eligible individuals must visit the ALDI Location on the Event Date. No purchase or payment is required to participate. Participants who arrive before the ALDI Location opens for business on the Event Date will be asked to line up in the order in which each person arrived. The first two hundred (200) participants to visit (as determined by Sponsor, in its sole discretion) will each receive one (1) laminated card, labeled with a number between one (1) and two hundred (200) determined by the participant’s position in line / order of entry into the ALDI Location (the “Entry Card”), while supplies last. As participants enter the ALDI Location, they will exchange their Entry Card for a Golden Ticket gift card (the “Prize”) which will vary in value based as described below. Limit one (1) Entry Card and one (1) Prize per household in the Promotion. Entry Cards will be made available on a first-come, first-serve basis while supplies last and Sponsor does not guarantee the opportunity to receive an Entry Card. Any participant who attempts to participate multiple times is in violation of these Official Rules and may be disqualified. In the event of a dispute about the identity of a participant, Sponsor may disqualify the participant in its sole discretion. Sponsor is the official timekeeper for the Promotion. By entering the Promotion, each participant agrees to be bound by these Official Rules, instructions of Sponsor’s representative(s) on site at the ALDI Location, and the decisions of Sponsor’s representative(s) in connection with the Promotion, whose decisions are final and binding on all matters relating to the Promotion. Winning a Prize is contingent upon fulfilling all requirements in these Official Rules.

5. Prizes/Approximate Retail Values (“ARV”):

The first two hundred (200) eligible individuals to visit the ALDI Location during the Promotion Period will receive one (1) Entry Card which can be exchanged for a Prize. The available Prizes, described in more detail below, will be allocated at random to each winner.

The odds of being one of the first 200 people to arrive at the ALDI Location on the Event Date depend on the number of participants and the time of each participant’s arrival. Once a participant has been identified as one of the first 200 visitors and provided an Entry Card, the odds of receiving a particular Prize are as described above.

Total ARV of all available prizes: $3,000

LIMIT ONE (1) PRIZE PER HOUSEHOLD.   If legitimately claimed, each Prize will be awarded. In the event that fewer eligible participants visit the ALDI Location during the Promotion Period than there are Prizes available in the Promotion, remaining Prizes will go unawarded. Winners may not substitute, assign or transfer award or redeem the Prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute the Prize with one of equal or greater value. Gift cards are subject to additional terms and conditions specified by Sponsor as disclosed on the gift card itself or in its accompanying materials. Gift cards may not be used online or in conjunction with any other offer or discount. All Prize details are at Sponsor’s sole discretion and certain limitations and restrictions may apply. Sponsor will not replace any lost, mutilated, or stolen Prizes. Sponsor is not responsible and will have no liability for winner’s inability to accept or use the Prize for any reason – in which case the unaccepted or unused part of the Prize will be forfeited, and Sponsor will have no further obligation with respect to that Prize or portion of the Prize.

Sponsor reserves the right at its sole discretion to choose an alternate winner in the event that a potential winner has been disqualified or is deemed ineligible, in Sponsor’s sole discretion. Winners are responsible for payment of any costs and expenses associated with Prize acceptance or use, as well as any federal, state, or local taxes arising out of Prize acceptance. Federal IRS 1099-MISC forms and other tax-reporting documents may be issued as appropriate in Sponsor’s sole discretion. As a condition of receiving a Prize, the winner may be required to complete and sign an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law), any required tax documentation, and any other documents required by Sponsor – any or all of which may require winner to provide their Social Security Number or other government-issued identifier (collectively, the “Winner Documents”). Failure to complete and return the Winner Documents in the form provided by Sponsor’s representative, and in accordance with Sponsor’s representative’s instructions, may result in forfeiture of the Prize.

6. Liability & Publicity Release / Indemnity / Limitation Of Liability:

The Released Parties are not responsible for errors or problems of any kind, whether human, printing, typographical, mechanical or otherwise, relating to or in connection with the Promotion, including, without limitation, errors or problems which may occur in connection with the administration of the Promotion, the identification of eligible participants or distribution of Entry Cards, the allocation and distribution of Prizes, or in any Promotion-related materials.   Persons who tamper with or abuse any aspect of the Promotion, as solely determined by Sponsor, will be disqualified and all associated Entry Card(s)/Prize claim(s) will be void. Should any portion of the Promotion be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, or fairness of the Promotion (including – without limitation – any suspicion or identification of line-jumping or other breakdown of the system used by Sponsor to identify the order of arrival of participants for purposes of the Promotion), Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Promotion (or any portion thereof). By participating, participants agree that the Released Parties will have no liability whatsoever for, and shall be held harmless by participants against, any liability, for any injuries, losses or damages of any kind, including death, to persons or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in the Promotion – including, without limitation, while traveling to or from any Promotion-related event and/or the ALDI Location.   As a condition of participating, participant agrees (and agrees to confirm in writing) that, to the maximum extent permitted by applicable law: (a) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, special damages, lost profits, and/or any other damages, other than for actual out-of-pocket expenses, not to exceed ten dollars ($10.00), arising directly from participant’s participation in the Promotion; (b) all causes of action arising out of or connected with the Promotion, or any item awarded, shall be resolved individually, without resort to any form of class action; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, (if any) not to exceed ten dollars ($10.00), but in no event will attorneys’ fees be awarded or recoverable; and (d) participant’s remedies are limited to a claim for money damages (if any) and participant irrevocably waives any right to seek injunctive or equitable relief – provided that nothing in these Official Rules will restrict a California resident’s rights under applicable law (if any) to seek public-injunctive relief (in accordance with the arbitration requirements below).

To the maximum extent permitted by applicable law, participant agrees to release, hold harmless, and indemnify Sponsor from and against any liability whatsoever for injuries or damages of any kind sustained in connection with the acceptance, use, misuse, or awarding of a Prize or while preparing for, or participating in any Prize- or Promotion-related activity including, without limitation, any injury, damage, loss, death or accident to or of person or property.    

Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any Prize furnished in connection with the Promotion.   Without limiting the generality of the foregoing, such Prizes are provided “as is” without warranty of any kind, either express or implied, and Sponsor hereby disclaims all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement.

Winners, by acceptance of a Prize, grant (except where prohibited by law) permission for Sponsor and its designees to use their name, address (city and state), photograph, likeness, voice, Prize information, and any other personal attribute protectable under applicable law for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval – provided that Sponsor is not obligated to make any use of the rights granted hereunder.

In the event that, for any reason, more purported winners come forward with ostensibly valid Prize claims than there are remaining Prizes available (e.g., if more participants present Entry Cards for redemption than there are Prizes left to be distributed), then the remaining Prizes will be allocated among all such participants via random drawing and inclusion in the random drawing will be each participant’s sole remedy in such event.

7. Force Majeure:

In the event Sponsor is prevented from awarding Prizes or continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to fire, flood, earthquake, windstorm, epidemic, pandemic, Covid-19 or similar related issues, public health crisis, disease, virus, sickness or outbreak or other similar or dissimilar natural disaster; act of God or public enemy; riot or civil disturbance; act of any government or governmental authority; power failure, satellite or equipment failure, failure of telecommunications lines or failure or breakdown of plant, machinery or vehicles operated by a third party; labor dispute, strike, or lockout; armed conflict, terrorist attacks, war (declared, undeclared or threatened), explosion, nuclear, or chemical or biological contamination; labor or material shortage, transportation interruption of any kind, work slow-down; or a government-imposed travel ban, restriction on movement or gatherings, or other government-imposed mandate of any kind, order of any court or jurisdiction; or any other cause not reasonably within Sponsor’s control whether or not specifically mentioned above, Sponsor reserves the right to modify, suspend, or terminate the Promotion without liability to any participant.

8. Governing Law:

By participating, participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Illinois, without giving effect to any choice of law or conflict of law rules.   By participating, participants consent to the jurisdiction and venue of the federal, state and local courts located in or having jurisdiction over Cook County, Illinois (subject to the Arbitration Agreement, immediately below).

9. Arbitration Agreement:

Except where prohibited by law, as a condition of participating in the Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with the Promotion (including, without limitation, disputes regarding the enforceability of this Arbitration Agreement), or any Prizes provided, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding individual arbitration under the Streamlined Arbitration Rules & Procedures (“Rules”) of JAMS and, if any in-person hearing is required, held in: (i) Chicago, IL; New York, NY; Los Angeles, CA; Seattle, WA; Atlanta, GA; or Houston, TX (whichever is closest to participant’s residence), (ii) another mutually agreed upon location; or (iii) where required by the JAMS’ Rules – in or near participant’s county of residence; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in the Promotion) not to exceed ten dollars ($10.00), and participant further waives all rights to have damages multiplied or increased. In the event that JAMS is unable or unwilling to set an arbitration schedule within thirty (30) days of the filing of a demand for arbitration, then the dispute may be brought before an alternate arbitration service mutually agreed upon by the parties. In the event that an arbitrator or court of competent jurisdiction holds that the class waiver requirement of this Arbitration Agreement is unenforceable for any reason, then any dispute arising out of or related to the Promotion or any Prize awarded must be brought in the state or federal courts located in or having jurisdiction over Cook County, Illinois, and each participant consents to and waives objection to the jurisdiction of such courts. Either party may, notwithstanding this provision, bring qualifying claims in small-claims court.   Participant must commence any arbitration or other claim within one (1) year after the dispute arises, otherwise the claim is permanently barred, which means that participant will no longer have the right to assert a claim regarding the dispute.

To begin a claim, participant must first send a letter describing participant’s claim in detail, including participant’s name and contact information, participant’s legal claim, the specific facts giving rise to participant’s claim. Participant’s letter must include the date(s) and amount(s) of any relevant transaction or interaction with Sponsor and participant’s requested relief. The letter must be sent to Attn: Legal Department, ALDI, Inc., 1200 N Kirk Rd., Batavia IL 60510. Participant and Sponsor agree to attempt in good faith to negotiate an informal resolution of participant’s claim. If a resolution is not reached within sixty (60) days, participant may commence an arbitration action as set forth herein. Subject to the arbitration provider’s rules, participant’s demand for arbitration must clearly identify the claimant, the claimant’s legal claims and specific requested relief and, if filed by legal counsel, proof of express authorization by the claimant to file the arbitration demand submitted with the arbitration demand.

To the extent any claim, dispute or controversy regarding the Promotion is not arbitrable under applicable laws or otherwise: participant and Sponsor both agree that any claim or dispute regarding the Promotion will be resolved exclusively in an Illinois court governed by the laws of the State of Illinois, without respect to its conflict of laws principles. The exclusive place of jurisdiction for all disputes arising from or in connection with the Promotion is Cook County, Illinois, or the United States District Court for the Northern District of Illinois and our dispute will be determined under Illinois law.

Both participant and Sponsor waive the right to a trial by jury and the right to bring or resolve any dispute as a class, consolidated, representative, collective, or private attorney general action.   Notwithstanding any provision in the JAMS Rules to the contrary, the arbitrator shall not have the authority or any jurisdiction to hear the arbitration as a class, consolidated, representative, collective, or private attorney general action or to consolidate, join, or otherwise combine the claims of different persons into one proceeding.

This Arbitration agreement will survive the termination of participant’s relationship with Sponsor.

10. Privacy

The personal data collected will be stored, processed, and transmitted in accordance with applicable data protection laws and Sponsor’s Privacy Policy (https://www.aldi.us/online-privacy-notice/) pursuant to participant’s agreement to these Official Rules.

11. General Rules:

  1. Decisions of the Sponsor are final on all matters relating to the Promotion, including interpretation of these Official Rules, determining the winners, and awarding of the Prizes. Sponsor’s failure or decision not to enforce any provision in these Official Rules will not constitute a waiver of that or any other provision.   In the event there is an alleged or actual ambiguity, discrepancy, or inconsistency between disclosures or other statements contained in any Promotions-related materials, privacy policy or terms of use on any website, social media platform or application and/or these Official Rules (including any alleged ambiguity, discrepancy, or inconsistency within these Official Rules), it will be resolved by Sponsor in its sole discretion.   Participants waive any right to claim ambiguity in the Promotion or these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.  
  2. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision.   In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules will otherwise remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein (except as expressly set forth in the Arbitration Agreement, above).    
  3. If the Promotion is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify, or suspend the Promotion and award the Prizes as deemed fair and appropriate by Sponsor.    
  4. Participants agree to not damage or cause interruption of the Promotion and/or prevent others from participating in or engaging with the Promotion. Sponsor reserves the right, in its sole discretion, to disqualify any participant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness, or proper play of the Promotion (including, without limitation, by attempting to cut in line at the ALDI Location or otherwise obtain an Entry Card or Prize by fraudulent means).    
  5. If Sponsor determines at any time in its sole discretion that a participant is disqualified, ineligible, in violation of these Official Rules, or engaging in behavior that Sponsor deems obnoxious, inappropriate, threatening, illegal or that is intended to annoy, abuse, or harass any other person, Sponsor reserves the right to disqualify that participant, even if the disqualified participant may have been identified as a winner or provided with a Prize. In such case, disqualified participant agrees to promptly return to Sponsor any Prize they have been provided.  
  6. If any person supplies false information, obtains an Entry Card or Prize by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain a Prize, Sponsor may disqualify that person and seek damages from them and that person may be prosecuted to the full extent of the law. If a dispute cannot be resolved to Sponsor’s satisfaction, the participant will be deemed ineligible. Caution: any attempt to undermine the legitimate operation of the Promotion may violate criminal and civil laws. If such an attempt is made, Sponsor may disqualify any participant making such attempt and may seek damages to the fullest extent permitted by law.  
  7. If any provision of these Official Rules is found to be unlawful, void or for any reason unenforceable, then that provision will be deemed severable from these Official Rules and will not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Official Rules solely for convenience or reference and will not be deemed to affect in any manner the meaning or intent of these Official Rules or any provision in these Official Rules.

These Official Rules may only be copied for personal use and not for any commercial purpose whatsoever. All rights reserved.  

A copy of these Official Rules can be obtained from Sponsor’s representative at the ALDI Location during the Promotion Period.
